Client was arrested and charged with murder under penal code 187. By statute, client faced 25 years to life in state prison. The alleged victim was shot in the head by the client. The defense argued that the client acted in self-defense even though no gun was found on the decedent. Attorney George Kita immediately went to the crime scene, with several former LAPD crime scene investigators, and reconstructed the entire crime scene. He also hired several forensic consultants. The scientific evidence showed that the decedent had gun shot residue on his hands consistent with the defense position of self defense (i.e. that the decedent fired a weapon). Furthermore, and complicating the case for the prosecution was the fact that the first police officer who arrived at the crime scene was terminated from the police department for unrelated matters. Finally, the witnesses for the decedent were unreliable and not credible. After 6 months of court proceedings, the case was dismissed and client was released from custody that same day.


Client was arrested for possession for sales of marijuana. They found a scale, many baggies, text messages, and marijuana. The charge is a straight felony that cannot be reduced to a marijuana by statute. Mr. Kita was able to get the charge dismissed and resolved for a misdemeanor possession charge with no jail.

Rape, Sodomy & Oral Copulation
Client was arrested and charged with rape, sodomy, and oral copulation. By statute, client faced 35 years to life in state prison. The complaining person was reportedly badly beaten with bruises all over her body. Attorney George Kita quickly assembled a first rate defense involving defense medical experts, forensic consultants, and three investigative teams. The defense medical expert indicated that the medical evidence showed no trauma to the victims vaginal area and therefore consistent with consensual sex. The investigation showed that the complaining person had fabricated her identity to the police. That the complaining party had several warrants for her arrest. That the complaining party reported a false claim of rape, sodomy and oral copulation. After one year of court proceedings, the case went to jury trial. After winning a series of defense motions, the case resolved on the third day of trial with all rape, oral copulation and sodomy charges dismissed with the client receiving zero jail time.

Child Molestation
Client was arrested on fabricated trumped up charges of child molestation. The accuser was the client’s 15 year old niece. Attorney George Kita was able to attack the case on several fronts. First, the client was gay and had never shown any interest in women. Second, Mr. Kita obtained the personal diary of the complaining person. Interestingly, there was no reference of molestation whatsoever of the dates the molestation supposedly occurred. In fact, no reference for an entire one-year period that more than covered the dates the alleged incident happened. Mr. Kita also obtained a taped statement of the complaining party admitting that she had consensual sex with other persons. This was important to refute the prosecutions medical report that stated the physical injuries were consistent with her ‘story’. This showed that any trauma to her vaginal area was from her having active sex with others. Mr. Kita, also lined up a series of character witnesses who said the minor had a history of fabricating stories. Finally, Mr. Kita forged an unusual alliance with tile Department of Social Services who indicated that their own investigation concluded that the minor was not credible and that they were satisfied that no molestation had occurred. The case was dismissed.

Operating a Chop Shop (Major Car Theft Operation)
Client was arrested and charged with operating a vehicle chop shop where stolen cars were allegedly taken to his place of business to have its VIN numbers switched, cars stripped down, and then placed on the market for sale. Client faced up to 12 years in state prison. Police, armed with search warrants, raided the clients’ place of business and recovered three stolen cars, three VIN stamps, and stolen vehicle parts. The co-defendant on the case admitted to embossing illegal VIN numbers to the stolen vehicles but told police he was lured by his "boss", the Client to do it. The co-defendant, represented by the public defender, took a plea bargain deal prior to preliminary hearing for four years in state prison even though he was dying from kidney problems that required weekly dialysis treatment. Mr. Kita pressed his case forward and prepared his case for jury trial. Shortly before trial was to commence, the case resolved with all chop shop charges dismissed and the client receiving zero jail time.

Forgery, Fraud, and Tendering Bad Check
Client was arrested and charged with multiple felony counts including tendering a bad check, forgery and fraud. Attorney George Kita quickly assembled a first rate defense team which included a nationally recognized handwriting expert. Mr. Kita was able to show the hand writing exemplars did not match that of the client. Furthermore, Mr. Kita was able to show that the complaining party was not credible and that he had serious credibility problems including allegedly defrauding his former business partners in another state. Mr. Kita was able to show that the prosecutions star witness was a liar. The case was dismissed at trial.

Driving Under the Influence with .27 Blood Alcohol Level
Client was arrested and charged with a second time DUI with a blood alcohol level of .27 which is three and a half times the legal limit. Prior to hiring Mr. Kita, the client consulted with several lawyers - all of whom informed the client there was no hope. Mr. Kita took the case and saw several weaknesses in the prosecutions case. Mr. Kita consulted with a blood alcohol expert who formerly supervised the L.A. County Sheriffs Crime Lab. At trial, the case was dismissed due to procedural due process problems as well as failure to comply with certain discovery requests. The client avoided having to go to DUI classes, jail, fines and most important of all, two year suspension on his drivers license. This is among the highest blood alcohol cases dismissed in Los Angeles County.

Driving Under the Influece and Weaving for Two Miles
Client was arrested and charged for having a blood alcohol level of .08 or greater and for weaving for two miles at a driving speed of 85 miles per hour. Mr. Kita had the clients blood sample retested by a prominent forensic toxicologist. Mr. Kita also retained a former L.A. County Sheriffs Crime Lab Supervisor to testify at trial. The District Attorney relied on their Senior CHP Officer who qualified as a DRE (Drug Recognition Expert). The CHP expert also trains other officers. The prosecution also brought in a forensic expert from the Sheriffs Crime lab. Mr. Kita was able to attack the reliability of the prosecution evidence at trial and the jury returned a not guilty verdict.


Driving under the influence with a .15 Blood Alcohol Level

According to the California Highway Patrol, client supposedly drove against a one way street in the City of Pasadena. Client denied that. Mr. Kita filed a motion to suppress and was able to destroy the credibility of the officer. The court granted the motion to suppress and the case was dismissed.

Driving under the influence with .15 Blood Alcohol Level
Client was arrested and charged for having a blood alcohol level of .15. At the time, client worked as a armored car driver and although the incident occurred after hours in his private vehicle, a conviction would have resulted in a termination of his livelihood. Mr. Kita challenged the traffic stop as being illegal due to the fact that the stop occurred at 1:00 a.m. and that client was stopped for having a small object hanging from his rear view mirror. On the day of the motion, Mr. Kita vigorously cross-examined the LAPD officer who could not recall many details of the stop nor what the object looked like. Furthermore, the prosecution had erroneously cited the wrong vehicle code section in its pleading and the officer testified to the wrong vehicle code section under oath as well. Mr. Kita's motion to dismiss the case based on a illegal traffic stop was granted by the judge.

Driving Under the Influence with .15 Blood Alcohol Level
Client was arrested and charged with a third time DUI. He blew a .15 BAC on the breath testing machine. Client was exposed to a three year license revocation and 120 day to 1 year in jail in addition to a 30 month alcohol program. Mr. Kita filed a 1538.5 motion to supress the evidence based on a illegal traffic stop. After a series of court hearings, the case ultimately was dismissed by the judge. The client avoided any DUI penalties whatsoever. No school, fine, or suspension.

Driving Under the Influence
Client was arrested and charged with DUI and for refusing to take a chemical test. It took only 3 days to complete the trial but the jurors took another 2 1/2 days deliberating before a judge declared a mistrial.

Possession of Cocaine
Client was charged with possessing cocaine. The white powdery substance tested positive for cocaine. Attorney George Kita filed a motion to dismiss based on a constitutional violation. The judge granted the motion and the case was dismissed.

Assault With a Deadly Weapon
Client was arrested and charged for assault with a deadly weapon. Mr. Kita prepared the case for jury trial. The complaining party was not credible. The case was dismissed at trial.

Hit and Run
Client was arrested and charged for hit & run. Client was identified by his vehicle license plate and thru a six pack photo line up. A criminal conviction would have cost the client his job. Attorney George Kita filed a motion to dismiss based on a provision of the penal code. The motion was granted and the case was dismissed.

Grand Theft of $5,000.00 of Pepsi Soda
Client and co-defendant were both charged with grand theft for stealing $5,000.00 worth of Pepsi sodas. The co-defendant, represented by the public defenders office took a plea bargain of 45 days of Caltrans (picking up trash). Mr. Kita took his case to jury trial. The prosecutor forgot to subpoena his witnesses. The case was dismissed at trial.
